A New Era: Implementation of Modern KUHP and KUHAP in Indonesia

The introduction of the new KUHP and KUHAP laws marks a significant update to Indonesia’s legal framework, ending centuries-old colonial norms. The Minister of Immigration and Human Rights, Yusril Ihza Mahendra, highlighted the significance of this move, talking about a shift to a more humane and modern legal regime rooted in Indonesian values and the principles of Pancasila.

These changes stem from the adoption of two important pieces of legislation: Law No. 1 of 2023 and Law No. 13 of 2024. The new legal framework is expected to enhance human rights protection and provide a more modern and equitable judicial character.

Yusril emphasized that the new version of KUHP and KUHAP also replaces outdated law adopted during the Orde Baru era. Despite its positive aspects, the old law did not adequately account for the changes and development of the concept of human rights following the amendments to the 1945 Constitution.

These innovations have received broad support from the government and legal experts, who note that the time for reform has long been due. The new KUHP is oriented towards approaches that help ensure fair trials and a qualitative improvement in legal and judicial processes.

Police representatives have already begun integrating the new code into their work, promising a more suitable response to offenses and an overall improvement in the justice system.

It is also mentioned that the implementation of these new laws will be supported by appropriate training and development programs for legal bodies, ensuring effective and timely enforcement of the new provisions.

Thus, Indonesia is taking an important step towards strengthening its legal system, which will positively impact all areas of society.
