A New Era of Indonesian Criminal Law: Introduction of New KUHP and KUHAP

January 3, 2026, marked a pivotal moment in Indonesian history as the country has completely moved away from outdated colonial laws. With the introduction of a new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP), steps have been taken towards a more modern and humane approach to justice. Minister of Law and Human Rights Yusril Ihza Mahendra noted that this shift signifies a transition from repressive measures to those promoting rehabilitation and social justice. The old law, based on Dutch legislation from 1918, was no longer relevant and failed to reflect the dynamics of modern-day Indonesia. Now, the new code offers alternative punishment measures such as community service and mediation, with a strong emphasis on rehabilitation. Additionally, local traditions and culture are incorporated into the legislation, allowing for considerations of Indonesia’s societal specifics. This change has also increased transparency and accountability in the legal system by implementing visual recordings of interrogations and strengthening the protection of victims and witnesses. Implementing such measures highlights Indonesia’s commitment to justice that reflects both international and national ethical standards.
