New Indonesian Penal Code (KUHP) and Criminal Procedure Code (KUHAP) Enforced: A Long Journey to Reform

On the first day of the new year, a landmark event took place in Indonesia, altering the country’s legal system. After years of struggle, the new legislation—the Penal Code (KUHP) and Criminal Procedure Code (KUHAP)—has finally been enforced. This legislation is intended to replace outdated laws inherited from the Dutch colonial rule and the ‘New Order’ regime. Exclusively for our newspaper, Chairman of the Parliamentary Commission III, Habiburokhman, shared his insights, expressing emotions and pride for the work accomplished. According to him, this marks the beginning of a new era where the legal system will become more humane and just. “This process took a lot of time and effort, but we have achieved our goal,” he stated. The legal reforms in Indonesia have sparked much debate and mixed reviews. Despite critical voices, mainly from the academic sphere, Indonesian authorities are confident that the new legislation will be a step towards improving judicial practices and human rights protection. The changes include more humane punishment measures and strengthened citizens’ rights protection, providing a significant contribution to the development of a legal society.
