A New Path in Indonesian Islamic Civil Law: Integrating Contextual Wisdom
At UIN Walisongo University in Semarang, a significant event unfolded as Professor Ali Imron was inaugurated as a professor of Islamic Civil Law. In his speech, he emphasized the necessity of moving away from purely textual applications of norms to a more socially adapted law. He proposed the concept of ‘contextual wisdom,’ which should make Islamic law more adaptive and relevant to the complex social structure of Indonesia. Imron highlighted that judicial ijtihad (judicial discretion) plays a critical role in ensuring justice, considering not only legal norms but also the socio-economic conditions of the parties. His approach focuses on protecting issues like women and children’s rights and creating a sustainable social environment post-judgment. He also stressed the importance of methodological boundaries to avoid excessive subjectivity that threatens legal clarity. His ideas resonate with the constitutional mandate of ensuring social justice, as enshrined in Indonesia’s Constitution.
