New KUHAP: A Guide to Preventing the Criminalization of the People

A new legal framework has been implemented in Indonesia, aimed at preventing unjust criminalization of its citizens. The new Code of Criminal Procedure (KUHAP) came into effect on January 2, 2026, providing a refreshed vision for the country’s justice system. Member of Commission III of the People’s Representative Council (DPR) Rudianto Lallo highlighted the importance of the legislative update as a measure against injustice and misuse of power. KUHAP is designed to achieve equality between the state and citizens, and promote restorative justice in place of past retributive practices. Through these developments, Indonesia’s justice system aims to be more humane and equitable, anchored in Pancasila values and the nation’s cultural heritage.
