Legal and Linguistic Experts Explain the Meaning of 'Mandatory' in the Use of Indonesian in Memorandums

A session was held in JAKARTA by the Constitutional Court (MK) discussing the mandatory use of the Indonesian language in memorandums as stipulated by Law No. 24 of 2009. Experts explained the importance of using the national language to protect Indonesia’s sovereignty and honor. The case is being evaluated amidst two court filings by various citizens. During the session, Professor Yohanes Sogar from Airlangga University emphasized that the law mandates the use of the Indonesian language in memorandums involving Indonesian state and private entities. However, the absence of penalties for violating this rule raises questions of legal clarity and potential risks to international agreements. The educational and non-repressive nature of this regulation was highlighted. Other experts expressed concerns that additional penalties could complicate international relations and would not align with international legal practices.
